Terms and conditions.
1. Who we are
This store is operated by Brave Particle, Unipessoal Lda, a company registered in Portugal, which sells and invoices every BAROC order.
2. Products and orders
Products are sold at three stated speeds: in stock (dispatched within 48 hours), made to order (produced in a standard size after purchase, about 10 days), and made to measure (produced from the measurements you provide — knitwear in 2–3 weeks; tailoring at the production speed you choose, from 2 weeks down to 1 day in the workshop). The applicable speed and estimated production time are stated on each product page before you buy.
To order, add pieces to your bag — configuring them and entering your measurements where the piece asks for it — then give your delivery address, choose a delivery option and a payment method, and review the order. Every detail can be corrected until you pay; paying places the order.
An order is accepted when we confirm it by email. That email and these terms are your record of the contract; signed-in customers also find their orders in their account. We may decline or cancel an order in case of manifest pricing error or unavailability, refunding any amount paid in full.
These terms are available in Portuguese, English and Spanish, and the contract may be concluded in any of these languages. In case of discrepancy between the versions, the Portuguese version prevails.
3. Prices and payment
Prices are in euros and include VAT. For deliveries within the EU, VAT is charged at the rate of the country of delivery (EU One-Stop Shop scheme); deliveries to the Azores and Madeira are dispatched from mainland Portugal and carry its 23% rate. Deliveries outside the EU VAT area carry no VAT — see clause 4.
Payment is taken at checkout by card, Apple Pay or Google Pay on Stripe's secure payment page (Stripe Payments Europe), or, for deliveries within the EU, by MB WAY, processed by euPago, a Portuguese payment service provider. We never see or store full card details.
4. Delivery
We deliver to the 27 EU member states, Switzerland, the United States and Canada. Shipping costs depend on the destination and the service chosen (see Shipping and Returns) and are always shown at checkout before you pay.
Orders shipped outside the EU — and to the Canary Islands, Ceuta and Melilla, which are outside the EU VAT area — are exported without VAT: no VAT is charged, and local import duties and taxes may be due on delivery, payable by the recipient.
Delivery estimates are production time plus carrier transit and are stated per product.
5. Right of withdrawal
Pieces bought as offered, without any configuration — pieces in stock, and pieces made to order in a standard size — may be returned within 14 days of delivery, without giving a reason (Decree-Law 24/2014). To withdraw, tell us within that period with a clear statement — an email to support@baroc.studio is enough; you may use the model form in clause 10, but you do not have to. Then send the pieces back within 14 days of telling us.
We refund all payments received for the order, including standard delivery costs (but not the extra cost of choosing express), within 14 days of being told of your decision, to the original payment method. We may hold the refund until we receive the pieces or you show that you have sent them, whichever comes first. Return shipping is paid by you, unless the piece was wrong or defective.
Try pieces on as you would in a shop and send them back with their labels attached. We may deduct from the refund any loss of value caused by handling beyond what is needed to check their nature, characteristics and fit.
Pieces made to measure, and any piece you configured — choosing its cloth, lining, buttons or any other option in the configurator — even in a standard size, are excluded from the right of withdrawal: they are made after your order from your individual choices, which makes them goods made to the consumer's specifications (Decree-Law 24/2014, art. 3.º(b) and art. 17.º(1)(c), which also excludes clearly personalised goods). This is stated on the product pages before purchase. Made-to-measure pieces carry the fit promise in clause 6 in its place; for every piece, your conformity rights in clause 7 are unaffected.
6. Fit promise (made to measure)
For made-to-measure pieces we offer one adjustment free of charge. If the fit is wrong due to our error, we remake the piece at no cost. Contact us within 30 days of delivery to arrange either.
7. Conformity
Every piece, made to measure and configured included, carries the legal guarantee of conformity: we answer for any lack of conformity that appears within 3 years of delivery (Decree-Law 84/2021). Nothing in these terms limits your legal rights under Portuguese and EU consumer law.
8. Complaints and disputes
Complaints may be submitted through the Portuguese electronic complaints book: livroreclamacoes.pt. For alternative dispute resolution, consumers may resort to CNIACC — Centro Nacional de Informação e Arbitragem de Conflitos de Consumo (cniacc.pt) or the consumer arbitration centre of their area of residence. The full list of these entities is on the Portuguese Consumer Portal (consumidor.gov.pt).
9. Governing law
These terms are governed by Portuguese law. Mandatory consumer protections of your country of residence remain unaffected.
10. Model withdrawal form
Complete and return this form only if you wish to withdraw from the contract.
